Les établissements de santé
Les conventions liant la caisse aux prestataires déterminent les droits et les obligations des parties contractantes, notamment :
- les prestations à fournir ;
- l’application de la tarification des prestations ;
- les modalités de paiement des prestations ;
- les modalités de contrôle de l’effectivité et de la qualité des soins.
Les conventions déterminent également les mesures appropriées pour favoriser l’accès aux soins des assurés et garantir la qualité et l’effectivité des soins.
Un règlement conventionnel minimal est établi par arrêté du ministre en charge de la sécurité sociale, après consultation d’une part, des organisations syndicales patronales et salariales les plus représentatives, et d’autres part, des organisations des professionnels de la santé.
Les conventions liant la caisse aux prestataires, ainsi que leurs avenants sont transmis par la caisse au ministre chargé de la sécurité sociale et au ministre chargé de la santé publique pour
approbation dans un délai maximum d’un mois à compter de leur réception. Passé ce délai, ils sont réputés approuvés. Les prestataires de santé conventionnés sont soumis au contrôle de la caisse. L’entrave à ce contrôle peut entrainer des sanctions allant jusqu’à la résiliation de la convention.
En cas d’hospitalisation, les prestataires sont tenus d’aviser la caisse, dans un délai lui permettant de s’assurer, le cas échéant, de la nécessité de voir prolonger l’hospitalisation au-delà du délai initialement prévu. En cas de carence du prestataire de santé, la caisse est fondée à refuser le remboursement de tout ou partie des éléments constituant les frais d’hospitalisation correspondant au séjour au-delà du délai prévu. Ces frais de séjour sont supportés par le prestataire lui-même.
